2. Subject matter and scope of the GTC
2.1. These General Terms and Conditions (hereinafter: GTC) set out the content of the contract for the sale of Goods concluded at a distance, by electronic means, between the Trader and the person purchasing through the Website (hereinafter: the Buyer) (hereinafter: the Contract). The Buyer reads and expressly accepts the GTC before submitting the order; the GTC form part of the Contract.
2.2. The meaning of capitalised terms is set out in Annex 1 to the GTC (Glossary), and a list of the main legislation applicable to the Contract is set out in Annex 2.
2.3. The provisions of the GTC do not deviate, to the detriment of the consumer, from the mandatory legislation protecting consumers; in the event of any deviation, the provisions of the legislation shall prevail. Rights granted by law exclusively to consumers — in particular the right to withdraw without giving any reason — do not apply to a Buyer who is not a consumer; the different rules applicable to such Buyers are summarised in the chapter entitled "Non-consumer Buyers".
2.4. The Contract is governed by Hungarian law. This choice of law does not deprive a consumer whose habitual residence is in another Member State of the European Union of the protection afforded to them by the mandatory provisions of the law of their country of residence.
2.5. The Trader makes the GTC continuously available on the Website in a form that can be stored and printed.
3. Language and form of the contract, invoicing
3.1. The language of the Contract is Hungarian or — in the case of an order placed on the English-language version of the Website — English. The Trader communicates with the Buyer in the language of the Contract.
3.2. The Contract does not qualify as a contract concluded in writing; the Trader does not file it, and it is therefore not subsequently accessible as a separate document. The content of the Contract is recorded jointly by the Trader's confirmation messages and the GTC in force at the time of the order.
3.3. The Trader issues an electronic invoice for the purchase in accordance with Section 175 of Act CXXVII of 2007 on value added tax, to the use of which the Buyer consents by submitting the order. The Trader sends the invoice to the e-mail address provided by the Buyer and, in the case of a registered Buyer, also makes it available in the customer account.
4. Amendment of the GTC and earlier versions
4.1. The Trader may amend the GTC with effect for the future. The amended GTC apply from the effective date published on the Website and cover only orders submitted after that date; orders already submitted and Contracts already concluded are governed by the text in force at the time of the order.
4.2. The Trader retains earlier versions of the GTC and makes them available on the Website together with their effective dates, so that the text in force at the time of purchase can be consulted subsequently.
PART II — PURCHASING ON THE WEBSITE
5. Product information and prices
5.1. The main characteristics and price of each item of Goods, and any restrictions relating to the purchase (for example, pack size, quantity that may be ordered, stock information), are set out on the product page. Product photos are illustrations; the characteristics of the Goods are determined primarily by the text description.
5.2. Where applicable to the Goods concerned and where the information is available to the Trader, the product page provides information on the producer's commercial guarantee of durability, for Goods with digital elements on the period during which software updates are provided, and on reparability and the availability of spare parts.
5.3. Prices are stated in the currency displayed on the Website (Hungarian forints or euros) and include value added tax: 27% VAT for Goods delivered to Hungary, and the VAT of the country of destination for Goods delivered to another Member State of the European Union. For deliveries outside the European Union, customs duties and import taxes arising in the country of destination are borne by the Buyer, unless the checkout indicates otherwise. The Trader shows the delivery charge and — where applicable — the charge for particular payment methods on the order summary page, before the order is submitted, both as a separate item and within the total amount payable.
5.4. The Trader may change prices with effect for the future. The price applicable to an order is the price displayed when the order is submitted, except in the case of a manifestly incorrect price.
5.5. The Trader does not personalise prices on the basis of automated decision-making.
5.6. A manifestly incorrect price includes, in particular, a price of HUF 0 or a symbolic price, and a price based on an erroneous calculation that is inconsistent with the discount displayed. In the case of such a price, the Trader does not accept the order, but makes a new offer to the Buyer stating the correct price; a Contract is concluded only if the Buyer accepts the new offer.
6. The ordering process and correction of input errors
6.1. Purchases can be made on the Website both with and without registration. The technical steps of placing an order are:
- selecting the Goods and adding them to the cart in the desired quantity;
- reviewing the contents of the cart and modifying them if necessary;
- entering the billing and delivery details;
- selecting the delivery and payment method;
- checking the products, charges and total amount payable on the summary page, and reading the GTC and the privacy notice;
- submitting the order using the button labelled to indicate an order with an obligation to pay.
6.2. Adding items to the cart and entering details do not yet create any obligation. Before submitting the order, the Buyer may check all entered data on the summary page and correct it in the cart, on the data forms, or by returning to any previous step using the browser's "back" function.
6.3. The Buyer may report an input error noticed after submitting the order at info@buildwithshark.com or by telephone at +36 30 849 6454; the Trader will correct the error — until dispatch has begun. The Buyer is responsible for ensuring that the details provided are genuine and accurate; the Trader may pass on to the Buyer any additional costs arising from inaccurate details (such as the charge for repeated delivery), provided that it substantiates them.
7. Conclusion of the contract
7.1. The range of products published on the Website constitutes an invitation to make an offer. The Buyer makes an offer by submitting the order; by submitting the order, the Buyer expressly acknowledges that, if accepted, the offer entails an obligation to pay.
7.2. The Trader confirms receipt of the order without delay by automatic e-mail. This message only records receipt and does not constitute acceptance of the offer. If this confirmation does not arrive within 48 hours of submitting the order, the Buyer is released from being bound by the offer.
7.3. The Contract is concluded when the Trader's declaration of acceptance of the offer, sent in a separate e-mail, becomes accessible to the Buyer in their mailbox. Failure to receive the confirmation may be caused by an incorrectly entered e-mail address or a full or filter-protected mailbox; in such a case, please notify the Trader.
7.4. The consumer may revoke their offer at any time until the Contract is concluded; revocation terminates the binding nature of the offer.
7.5. The Trader confirms the Contract on a durable medium (by e-mail) at the latest upon delivery of the Goods, and makes the GTC in force at the time of the order available to the Buyer in downloadable form.
8. Payment
8.1. The following payment methods are available on the Website:
- Cash on delivery — the Buyer pays the total amount payable to the courier or at the pick-up point upon receipt of the Goods.
- Online card payment (Shopify Payments) — payment is made through the Shopify Payments system by bank card or by a mobile wallet offered at checkout (e.g. Apple Pay, Google Pay, Shop Pay); the Trader has no access to card details.
8.2. The Trader clearly indicates the available payment methods at the latest when the order is submitted.
9. Delivery, receipt, time limit for performance
9.1. The ordered Goods may be delivered to or collected by the Buyer in the following ways:
- GLS home delivery (Hungary): Home delivery by GLS courier. Charge: HUF 2,050.
- DPD home delivery (Hungary): Home delivery by DPD courier. Charge: HUF 2,350.
- MPL home delivery (Hungary): Home delivery by Magyar Posta (MPL) courier. Charge: HUF 2,800.
- International delivery: Abroad by a courier service appropriate to the country of destination (e.g. GLS, DPD, UPS, DHL, Express One). The checkout shows the charge and the available options based on the delivery address, before the order is submitted.
9.2. The Trader indicates any restrictions on delivery (for example, restrictions on the delivery area or parcel size) at the latest when the order is submitted. The delivery charge is included in the order summary.
9.3. Unless otherwise agreed, the Trader makes the Goods available to the Buyer without undue delay after the conclusion of the Contract, and within Europe within 5 working days at the latest. If the Trader is in delay, the consumer may set an additional period for performance; if the Trader fails to perform within the additional period, the consumer may withdraw from the Contract. The consumer may also withdraw without setting an additional period if the Trader has refused to perform, or if, according to the parties' agreement or as recognisable from the circumstances, the Contract could only be performed at the specified time.
9.4. If the Trader is unable to perform because the ordered Goods are not available to it, it shall inform the Buyer of this without delay and refund any amount already paid without delay.
9.5. In the case of a consumer Buyer, the risk of loss of and damage to the Goods passes when the Buyer, or a person designated by the Buyer other than the carrier, takes possession of the Goods. Please inspect the consignment upon receipt in the presence of the courier or the pick-up point staff; in the event of visible damage, request that a damage report be drawn up, or refuse to accept delivery. The report facilitates subsequent handling, but its absence does not limit the Buyer's warranty, guarantee or withdrawal rights.
9.6. If the Buyer fails to accept the delivered Goods without a withdrawal notice or other good reason, the Trader may make redelivery conditional upon payment of a further delivery charge and may claim reimbursement of the costs demonstrably incurred as a result of the unsuccessful delivery.
9.7. If the Buyer has failed to accept an earlier order without good reason, the Trader may make the performance of further orders conditional upon prepayment of the purchase price and the delivery charge.
10. Purchasing from another Member State of the European Union
10.1. The Trader does not restrict access to the Website or purchasing on the basis of the Buyer's nationality, place of residence or place of establishment, and provides payment methods on the same terms within the internal market.
10.2. Unless otherwise indicated, the Trader undertakes delivery within the territory of Hungary. A Buyer purchasing from another Member State of the European Union may choose the same delivery and collection methods as a Buyer in Hungary and may receive the Goods — including by personal collection — under the conditions applicable to delivery performed in Hungary; the parties may also agree individually on delivery abroad.
10.3. The Trader is not obliged to communicate in the language of the Buyer's Member State, nor to comply with non-contractual requirements relating to the Goods (for example, labelling or sector-specific requirements) applicable in the Buyer's Member State.
PART III — RIGHT OF WITHDRAWAL
11. Who may withdraw from the Contract and within what period
11.1. A Buyer who qualifies as a consumer may withdraw from the Contract without giving any reason (Section 20 of Government Decree No. 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses). This right is not available to a Buyer who does not qualify as a consumer — including a legal person or a business purchasing in the course of its economic activity.
11.2. The withdrawal period is 14 days, starting on the day on which the consumer, or a third party other than the carrier indicated by the consumer, takes possession of the Goods. If the order comprises multiple Goods delivered at different times, the period runs from the day of receipt of the last Goods delivered; for Goods consisting of multiple lots or pieces, from receipt of the last lot or piece; and for regularly recurring deliveries, from receipt of the first delivery.
11.3. The right of withdrawal may also be exercised during the period between the day the Contract is concluded and the day the Goods are received.
11.4. If the Trader has failed to inform the consumer of the conditions, time limit and model form for exercising the right of withdrawal, the withdrawal period is extended by twelve months; if the Trader provides this information within those twelve months, the withdrawal period expires fourteen days after the day the information is communicated (Section 21 of Government Decree No. 45/2014 (II. 26.)).
12. How to exercise the right of withdrawal
12.1. The right of withdrawal may be exercised
- by completing and sending the model withdrawal form set out in Annex 3, or
- by any other statement clearly expressing the intention to withdraw.
12.2. The statement may be sent by e-mail to info@buildwithshark.com or by post to 9300 Csorna, Andrássy utca 38/C. The withdrawal is considered to be made in time if the consumer sends the statement on or before the last day of the withdrawal period. The burden of proving that the right of withdrawal was exercised in accordance with the law lies with the consumer; we therefore recommend sending the statement in a verifiable manner.
12.3. As soon as it becomes aware of the withdrawal, the Trader shall, without undue delay, send the consumer an acknowledgement of receipt of the withdrawal on a durable medium (by e-mail), stating its content and the date and time of its sending.
13. Return of the Goods and refund
13.1. The consumer shall return the Goods to 9300 Csorna, Andrássy utca 38/C, or hand them over to the Trader or to a person authorised by the Trader to receive them, within 14 days of communicating the withdrawal. The deadline is met if the consumer sends the Goods before the 14-day period expires.
13.2. The direct cost of returning the Goods shall be borne by the consumer. The Trader may refuse to accept a parcel sent cash on delivery or with postage payable by the recipient.
13.3. The Trader shall refund the full amount paid by the consumer, including the delivery charge, within 14 days of becoming aware of the withdrawal. If the consumer chose a delivery method more expensive than the least expensive standard delivery method, the Trader is not obliged to refund the difference.
13.4. The refund shall be made using the same payment method as used by the consumer; the Trader may use another method only with the consumer's express consent, and the consumer may not be charged any additional fee as a result.
13.5. The Trader may withhold the refund until it has received the Goods back or until the consumer has supplied conclusive evidence of having sent them back, whichever is earlier.
13.6. The consumer is liable for any diminished value of the Goods only if it results from handling the Goods beyond what is necessary to establish their nature, characteristics and functioning. If the Trader failed to provide information about the right of withdrawal, the consumer is not liable for any diminished value either.
14. When the right of withdrawal does not apply
14.1. Pursuant to Section 29 (1) of Government Decree No. 45/2014 (II. 26.), the consumer is not entitled to the right of withdrawal in particular in respect of
- Goods that are not prefabricated, are made according to the consumer's instructions or at the consumer's express request, or are clearly personalised for the consumer;
- Goods that are perishable or have a short shelf life;
- sealed Goods which, for health protection or hygiene reasons, cannot be returned once unsealed after delivery, if the packaging has been opened;
- Goods which, by their nature, are inseparably mixed with other items after delivery;
- sealed audio or video recordings or copies of computer software, if the consumer has opened the packaging after delivery;
- newspapers, periodicals and magazines, with the exception of subscription contracts;
- Goods or services whose price depends on fluctuations in the financial market which cannot be controlled by the Trader and which may occur within the withdrawal period;
- alcoholic beverages whose actual value depends on market fluctuations which cannot be controlled by the Trader, the price of which was agreed upon at the conclusion of the contract, but which can be delivered only after thirty days from the conclusion of the contract;
- digital content not supplied on a tangible medium, if performance has begun with the consumer's express prior consent, the consumer has at the same time acknowledged that they will lose the right of withdrawal once performance begins, and the Trader has confirmed this;
- services, after full performance, if performance began with the consumer's express prior consent and acknowledgement that they will lose the right of withdrawal once the service has been fully performed;
- work carried out at the consumer's express request for the purpose of urgent repairs or maintenance, and contracts concluded at a public auction;
- accommodation (other than for residential purposes), carriage of goods, car rental, catering, or services related to leisure activities, if the Contract provides for a specific date or period of performance.
PART IV — IF THE GOODS ARE DEFECTIVE: WARRANTY AND GUARANTEE
15. EU labels: harmonised notice and GARAN label
15.1. From 27 September 2026, the Trader publishes on the Website, in a clearly visible manner, in colour and without alteration, the harmonised notice on the statutory legal guarantee (warranty) of conformity laid down in Commission Implementing Regulation (EU) 2025/1960. The notice is directly accessible from the Website.
15.2. The harmonised notice serves as a reminder that, in the case of defective Goods, the consumer is entitled by law to a legal guarantee (warranty) of conformity for at least two years, which primarily provides for repair or replacement and, in certain cases, a price reduction or termination of the contract. The notice is general information: the consumer's detailed rights under Hungarian law are set out in the following sections, and the notice does not limit them.
16. When performance is in conformity with the Contract
16.1. At the time of performance, the Goods must comply with the Contract and with Government Decree No. 373/2021 (VI. 30.) on the detailed rules of contracts between consumers and businesses for the sale of goods and the supply of digital content and digital services. Accordingly, the Goods must in particular
- correspond to the description, quantity, quality and type set out in the Contract, and possess the functionality, compatibility, interoperability and other features specified in the Contract;
- be fit for any particular purpose for which the consumer requires them, which the consumer made known to the Trader at the latest at the time of the conclusion of the Contract and which the Trader accepted;
- be supplied with the accessories and instructions specified in the Contract — including installation and set-up instructions and customer support — and be updated as undertaken in the Contract;
- be fit for the purposes for which Goods of the same type would normally be used, as prescribed by law, technical standards or, in the absence thereof, applicable codes of conduct;
- possess the quantity, quality, performance and other features — in particular in terms of functionality, compatibility, accessibility, continuity and security — that are normal for Goods of the same type and that the consumer may reasonably expect, taking into account any public statement (for example, in advertising or on a label) made by the Trader, its representative or another person in the chain of transactions concerning the specific characteristics of the Goods;
- be delivered together with the packaging, installation instructions and other accessories and instructions that the consumer may reasonably expect to receive;
- correspond to the characteristics and description of the goods presented by the Trader as a sample or model, or made available as a trial version, before the conclusion of the Contract.
16.2. The Trader is not bound by a public statement if it proves that it was not, and could not reasonably have been, aware of it; that it had been duly corrected by the time of conclusion of the Contract; or that it could not have influenced the consumer's decision to conclude the Contract.
16.3. There is no lack of conformity if, at the time of conclusion of the Contract, the consumer was specifically informed that a particular characteristic of the Goods deviated from the above requirements and expressly and separately accepted that deviation when concluding the Contract.
16.4. The Trader is also in defective performance if the lack of conformity results from incorrect installation, provided that the installation formed part of the Contract and was carried out by the Trader or under its responsibility, or that the installation was to be carried out by the consumer and the lack of conformity is attributable to shortcomings in the instructions provided by the Trader.
17. Legal guarantee (warranty) of conformity — the Trader's liability
17.1. In the event of defective performance, the Buyer may assert a claim under the legal guarantee (warranty) of conformity against the Trader in accordance with the Hungarian Civil Code and, in the case of a consumer contract, also in accordance with Government Decree No. 373/2021 (VI. 30.).
17.2. The consumer may primarily request — at their choice — the repair or replacement of the defective Goods, unless fulfilling the chosen remedy is impossible or would impose disproportionate additional costs on the Trader compared with the other remedy, taking into account the value the Goods would have if there were no defect and the significance of the breach of contract.
17.3. Before bringing the Goods into conformity, the Trader shall inform the consumer that they may request repair or replacement at their choice, and that if the defect is remedied by repair, the limitation period for the claim under the legal guarantee (warranty) of conformity is extended once by twelve months (Section 13 (1a) and (4) of Government Decree No. 373/2021 (VI. 30.)).
17.4. For the duration of the repair, the Trader may lend replacement goods free of charge, which may also be refurbished goods; at the consumer's express request, the Trader may also effect the replacement with refurbished goods.
17.5. The Trader shall carry out the repair or replacement free of charge, within a reasonable period from the notification of the defect and without significant inconvenience to the consumer; for this purpose, the consumer shall make the Goods available to the Trader. The Trader shall be responsible for, and bear the cost of, taking back the replaced Goods and — if the Goods have already been installed in accordance with their intended purpose — removing the defective Goods and installing the repaired or new Goods.
17.6. The consumer may request a price reduction proportionate to the significance of the breach of contract or — except in the case of a minor defect — terminate the Contract if the Trader has not carried out the repair or replacement, or has not carried it out in accordance with the above conditions; has refused to bring the Goods into conformity; if a further lack of conformity has occurred; if the defect is so serious as to justify an immediate price reduction or termination; or if it is clear from the circumstances that the Trader will not bring the Goods into conformity within a reasonable time or without significant inconvenience to the consumer. The burden of proving that the defect is minor lies with the Trader.
17.7. The price reduction shall equal the difference between the value of the Goods in conformity with the Contract and the value of the Goods actually delivered. In the event of termination, the consumer shall return the Goods at the Trader's expense, and the Trader shall refund the purchase price without delay upon receipt of the Goods or of evidence of their return. If the defect affects only some of the Goods, termination is limited to those Goods, unless the consumer cannot reasonably be expected to keep only the Goods that are in conformity.
17.8. Under a consumer contract, the consumer may not repair the defect themselves, or have it repaired by a third party, at the Trader's expense (Section 6:159 (2a) of the Civil Code).
17.9. The consumer may switch from the chosen right under the legal guarantee (warranty) of conformity to another; the consumer shall bear the cost of switching, unless the switch was justified or the Trader gave cause for it.
17.10. If the defect becomes apparent within one year of performance, it shall be presumed — unless the Trader proves otherwise — to have already existed at the time of performance; this presumption does not apply if it is incompatible with the nature of the Goods or of the defect. After one year has elapsed, the consumer must prove that the defect already existed at the time of performance.
17.11. The defect must be notified without delay after its discovery; a defect notified within two months of its discovery shall be deemed to have been notified without delay. Under a consumer contract, the claim under the legal guarantee (warranty) of conformity becomes time-barred two years after performance. The period during which the consumer was unable to use the Goods for their intended purpose because of the repair is not included in the limitation period; for the replaced or repaired part, the limitation period starts anew.
17.12. The consumer may withhold all or part of any outstanding portion of the purchase price — in proportion to the significance of the breach of contract — until the Trader has fulfilled its obligations relating to the defective performance.
18. Product liability guarantee (producer's warranty) — the producer's liability
18.1. In the event of a defect in Goods sold by a business to a consumer, the consumer may — at their choice — assert a claim under the product liability guarantee (producer's warranty) instead of a claim under the legal guarantee (warranty) of conformity; the two claims may not be asserted simultaneously for the same defect.
18.2. A claim under the product liability guarantee (producer's warranty) may be asserted against the producer. The producer means the manufacturer and the distributor of the Goods; the consumer may primarily request the repair of the defect or, if repair is not possible within an appropriate period without harming the consumer's interests, the replacement of the Goods.
18.3. The Goods are defective if they do not meet the quality requirements in force at the time they were placed on the market by the producer, or if they do not have the characteristics stated in the producer's description. The consumer must prove the defect.
18.4. The defect must be notified to the producer without delay after its discovery; a defect notified within two months shall be deemed to have been notified without delay. The producer is liable under the product liability guarantee (producer's warranty) for two years from the date on which it placed the Goods on the market; after this period, the right lapses.
18.5. The producer is exempt from liability only if it proves that it did not manufacture or distribute the Goods in the course of its business or independent profession; that the defect could not have been detected according to the state of scientific and technical knowledge at the time the Goods were placed on the market; or that the defect resulted from the application of a legal provision or a mandatory regulatory requirement. The rights under the product liability guarantee (producer's warranty) may also be asserted by a new owner of the Goods.
19. Handling of warranty and guarantee claims
19.1. The Trader shall draw up a record of any warranty or guarantee claim notified to it, containing the consumer's name and address, the name and purchase price of the Goods, the date of performance and of the notification of the defect, a description of the defect, the right the consumer wishes to assert, and the manner in which the claim is to be settled or the reason for its rejection; if the Trader performs in a manner other than the right requested, the reason for this as well. The record shall provide information on the possibility of turning to a conciliation board. The Trader shall hand over a copy to the consumer without delay and in a verifiable manner, and shall keep the record for three years from the date on which it was drawn up.
19.2. If the Trader is unable to state at the time of notification whether the claim can be fulfilled, it shall inform the consumer of its position — and, in the event of rejection, of the reasons for it and of the possibility of turning to a conciliation board — within eight days, in a verifiable manner.
19.3. The Trader shall accept the Goods for repair or inspection against an acknowledgement of receipt stating the consumer's name and address, the identification details of the Goods, the date of receipt and the date on which the consumer can collect the Goods.
19.4. The Trader endeavours to complete the repair or replacement within fifteen days; if a longer period is required, it shall inform the consumer of the expected duration.
19.5. The consumer must prove the conclusion of the contract; presenting the invoice or receipt evidencing payment of the purchase price is sufficient for this purpose.
20. Buyers who are not consumers
20.1. A Contract concluded with a Buyer who does not qualify as a consumer is governed by the general rules of the Hungarian Civil Code. Such a Buyer is not entitled to the right of withdrawal without giving reasons, and the consumer protection rules of Government Decree No. 373/2021 (VI. 30.) do not apply to them.
20.2. Under the legal guarantee (warranty) of conformity, a Buyer who is not a consumer may primarily request repair or replacement; if the Trader does not undertake this, is unable to carry it out within an appropriate period, or the Buyer's interest in it has ceased, the Buyer may request a price reduction, repair the defect themselves or have it repaired by a third party at the Trader's expense, or — except in the case of a minor defect — withdraw from the Contract. The defect must be notified without delay after its discovery; the claim becomes time-barred one year after performance. A Buyer who is not a consumer may not assert a claim under the product liability guarantee (producer's warranty).
20.3. Micro, small and medium-sized enterprises purchasing in retail trade are entitled to the mandatory commercial guarantee and to initiate conciliation board proceedings in the same way as consumers.
20.4. The Trader's liability towards a Buyer who is not a consumer — except for breaches of contract committed intentionally or causing harm to human life, physical integrity or health — is limited to the amount of the purchase price of the Goods.
PART V — COMPLAINTS AND DISPUTES
21. Complaint handling
21.1. The Buyer may submit any objection concerning the conduct, activity or omission of the Trader, or of a person acting on the Trader's behalf, that is directly connected with the sale of the Goods (consumer complaint) in the following ways:
- by e-mail: info@buildwithshark.com;
- by telephone: +36 30 849 6454;
- by post: 9300 Csorna, Andrássy utca 38/C;
- via the contact option provided on the Website: https://buildwithshark.com.
21.2. Claims under the warranty and the commercial guarantee are not handled as complaints, but in accordance with the rules of the chapter entitled "Handling of warranty and guarantee claims".
21.3. The Trader shall examine an oral complaint immediately and remedy it as necessary. If the Buyer does not agree with the handling of the complaint, or if immediate investigation is not possible, the Trader shall without delay draw up a record of the complaint and of its position on it. In the case of a complaint made in person, a copy of the record shall be handed over on the spot; in the case of a complaint made by telephone, it shall be sent at the latest together with the substantive reply. A complaint made by telephone shall be given a unique identification number.
21.4. If the Buyer does not provide the data necessary for drawing up the record (name, residential address or e-mail address, and a description of the complaint), or refuses to sign the record, the Trader shall not be obliged to answer the oral complaint in accordance with the rules applicable to written complaints.
21.5. The Trader shall reply to a written complaint on the merits, in writing and in a verifiable manner, within thirty days of its receipt, and shall give reasons for any rejection. If the Trader provides an electronic form for submitting complaints, it shall confirm receipt of the complaint to the e-mail address provided without delay.
21.6. In the event of rejection, the Trader shall inform the Buyer in writing of the authority or conciliation board to which the Buyer may turn with the complaint, depending on its nature, including their contact details, and of whether the Trader has made a general declaration of submission.
21.7. The Trader shall retain the record of an oral complaint, the written complaint and a copy of the reply to it for three years.
22. Conciliation boards
22.1. Independent conciliation boards operating alongside the county (Budapest) chambers of commerce and industry are available for the out-of-court, settlement-based resolution of consumer disputes. The procedure is initiated at the consumer's request, on condition that the consumer has previously attempted to settle the dispute directly with the Trader; the procedure is free of charge for the consumer.
22.2. The board competent for the procedure is the one for the consumer's place of residence or place of stay; the consumer may also designate another board in the request. Unless the consumer requests a hearing in person, the hearing is held online by means of a device providing audio and video transmission.
22.3. The Trader shall cooperate in the conciliation board procedure: upon the board's request it shall send its statement of reply within the time limit, and shall ensure that a person authorised to conclude a settlement attends the hearing, at least online. The Trader has not made a general declaration of submission.
22.4. For the purposes of the conciliation board procedure, the following also qualify as consumers: a civil society organisation, ecclesiastical legal person, condominium or housing cooperative acting outside the scope of its economic activity, and a micro, small or medium-sized enterprise purchasing goods in the context of retail trade; consumer status is examined by the board.

PART VI — MISCELLANEOUS PROVISIONS
25. Processing of personal data
25.1. The Trader processes the Buyer's personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the applicable Hungarian legislation. 27.2. The Trader shall not be liable for damage caused by circumstances beyond its control that were unforeseeable at the time the Contract was concluded, where it could not have been expected to avoid such circumstances or to prevent the damage. No provision of these GTC limits the Trader's liability for intentional breach of contract, for breach of contract causing damage to human life, physical integrity or health, or its liability towards consumers under the law.
28. Code of conduct, partial invalidity
28.1. The Trader has not submitted to any code of conduct under Act XLVII of 2008 on the Prohibition of Unfair Commercial Practices against Consumers.
28.2. If any provision of the GTC is invalid or ineffective, this shall not affect the validity of the remaining provisions; the provision of the law shall apply in place of the invalid provision.
